These Terms and Conditions (“Terms”) govern your use of Beyond by Evolve, including our website, mobile application and related services (together, the “Service”).
By creating an account, accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
1. About us
Beyond by Evolve is a patient support service operated by Evolve GLP-1, a healthcare advisory service run by an independent prescribing pharmacist.
The Service is designed to provide guidance, education and support for people using, tapering off, or stopping GLP-1 medications, as well as those seeking support with maintaining weight loss after treatment.
The Service may include:

educational content and resources
-
health and wellbeing support
-
app-based tools, check-ins and progress tracking
-
direct messaging support
-
access to one-to-one consultations or other paid support services where offered
We do not prescribe medication through the app.

2. Important medical disclaimer
The Service is provided for general information, support and advisory purposes only.
The Service is not a substitute for medical care
By using the Service, you acknowledge and agree that:
-
we do not provide emergency medical care through the Service
-
we do not provide medical diagnosis through the app
-
we do not prescribe medication through the app
-
the information, guidance and support provided through the Service is not a substitute for advice from your GP, specialist, prescriber or other treating healthcare professional
-
you remain responsible for decisions about your health, treatment and medication, including seeking appropriate medical advice when needed
You should always seek advice from your GP, prescriber, pharmacist or another appropriately qualified healthcare professional before making decisions about your medication, treatment or health.
Not an emergency service
The Service is not an emergency or urgent medical service. We do not guarantee continuous monitoring of messages or immediate responses.
You must not use the Service for urgent medical problems or emergencies, including if you are experiencing:

severe side effects or a serious reaction to medication
-
chest pain
-
breathing difficulties
-
symptoms of severe illness
-
suicidal thoughts
-
any situation where urgent medical attention may be required
If you think you may be experiencing a medical emergency, call 999 immediately.
For urgent medical advice, contact NHS 111, your GP, local urgent care service, or emergency services as appropriate.
3. Eligibility
To use the Service, you must:

be 18 years old or over
-
be resident in the United Kingdom
-
provide information that is accurate, complete and not misleading
-
use the Service only for lawful purposes and in accordance with these Terms
We may suspend, restrict or terminate access to the Service if you do not meet these eligibility requirements or if we reasonably believe you have provided false, incomplete or misleading information.
4. Your account
To use certain parts of the Service, you may need to create an account.
You are responsible for:
-
keeping your login credentials secure and confidential
-
all activity carried out under your account, except where this results from our failure to protect your account
-
ensuring that the information you provide to us is accurate and kept up to date
-
promptly notifying us if you believe your account has been accessed without permission or otherwise compromised
We may suspend, restrict or terminate your account if we reasonably believe:
-
your account is being misused
-
your use of the Service poses a risk to patient safety, our staff, other users or the integrity of the Service
-
you have breached these Terms
-
we are required to do so by law, regulation, safeguarding obligations or professional duties
5. Our services
Beyond by Evolve provides support services relating to GLP-1 use, tapering, withdrawal, maintenance and associated health and wellbeing considerations.
Depending on the services available at the time, the Service may include:
-
general health and medication-related guidance
-
educational information and resources
-
lifestyle, behaviour and wellbeing support
-
progress tracking, check-ins, scoring tools or app-based support features
-
direct messaging support
-
one-to-one consultations or booked support sessions with healthcare or allied professionals where offered
Direct messaging support
Where included within a subscription, direct messaging support allows a user to send messages through the app to the prescribing pharmacist or another authorised member of the Evolve GLP-1 team, subject to the scope of the Service and these Terms.
Unless otherwise stated at the point of purchase, messaging support included within a subscription is limited to:
-
up to 4 message threads per subscription month
-
each message thread lasting up to 48 hours from the first message sent by the user in that thread
-
up to 20 messages in total within each thread, including messages sent by the user and replies sent by Evolve GLP-1 through the app
A message thread means a single support conversation started by the user within the app. Once a thread has been opened, it will remain active for up to 48 hours and then close automatically, whether or not the full 20-message allowance has been used.
Any messages sent after a thread has closed may count as a new thread.
Unused message threads do not roll over into future subscription periods unless we expressly state otherwise.
Messaging is intended for non-urgent support only and must not be used for emergencies or urgent medical issues. We reserve the right to manage the operation of the messaging service, including response workflows, thread closure, fair use controls and clinical prioritisation, where reasonably necessary to operate the Service safely and effectively.
We may update, improve, suspend, modify or withdraw any part of the Service at any time, including features, content, pricing, support options or availability. We will try to give reasonable notice where changes are material, but we do not guarantee that any specific feature or element of the Service will always remain available.
6. User responsibilities and acceptable use
You agree that you will:
-
use the Service only for your own personal, non-commercial use unless we agree otherwise in writing
-
provide information that is true, accurate and complete
-
update your information if it changes
-
use the Service responsibly and not rely on it as your only source of medical advice
-
follow advice given by your own GP, prescriber or treating clinician where appropriate
-
seek appropriate medical attention for urgent, serious or worsening symptoms
-
comply with all applicable laws and regulations when using the Service
You must not:
-
provide false, misleading or inaccurate information
-
use the Service in a way that could endanger yourself, other users, our staff or the public
-
misuse the Service, interfere with its operation, or attempt to gain unauthorised access to accounts, systems or data
-
upload or transmit viruses, malicious code or harmful material
-
use the Service for unlawful, fraudulent or abusive purposes
-
impersonate another person or allow another person to use your account
-
send abusive, threatening, harassing, discriminatory or otherwise inappropriate communications through the Service
We may suspend or terminate access to the Service if you breach this section.
7. Payments, subscriptions and cancellation
Some parts of the Service may be offered on a paid subscription basis or as one-off paid services.
Subscription plans
If you purchase a subscription, the available plans may include:

a monthly subscription
-
a 3-month subscription
-
an annual subscription
The features included in each subscription, the applicable price and the billing frequency will be shown to you before purchase.
What a subscription may include
Depending on the subscription plan selected, your subscription may include access to:
-
app content and support tools
-
progress tracking and check-in features
-
direct messaging support subject to the messaging limits set out in section 5
-
other features described at the point of purchase
Automatic renewal
Unless otherwise stated at the point of purchase, subscriptions renew automatically at the end of the relevant billing period until cancelled.
By purchasing a subscription, you authorise the relevant app store or payment provider to collect recurring payments in line with the subscription plan you selected.
Cancelling a subscription
You may cancel your subscription at any time through:
-
the relevant app store account settings, where you subscribed through an app store, or
-
any other cancellation method that we make available to you
Unless we state otherwise at the point of purchase:
-
cancellation will prevent the next renewal payment
-
your subscription will usually remain active until the end of the current paid billing period
-
fees already paid for the current billing period are non-refundable, except where you have a legal right to a refund or where we choose to offer one at our discretion
Price changes
We may change subscription pricing from time to time. Where required, we will provide notice before any new price takes effect for a renewed subscription.
Failed payments
If a subscription payment fails or is not authorised, we may suspend access to paid features until payment is successfully processed.
App store billing
Where you subscribe through the Apple App Store or Google Play, billing, cancellation and refunds may also be subject to that platform’s own terms and policies.
8. 1:1 consultations, bookings and cancellations
We may offer one-to-one consultations, calls, video appointments or other booked support sessions through the Service, including with healthcare or allied professionals such as a pharmacist, nutritionist, personal trainer, counsellor or neurodiversity specialist.
Booking and payment
-
consultation fees will be shown before booking
-
payment may be required at the time of booking unless we state otherwise
-
appointment times are subject to availability
-
you are responsible for ensuring that the contact details you provide for the booking are correct and that you are available at the agreed time
Cancellation and rescheduling by you
If you wish to cancel a consultation, you must do so using the booking or cancellation method we specify.
Unless we agree otherwise in writing:
-
48 hours’ notice or more before the appointment – you will be entitled to a full refund
-
less than 48 hours before the appointment – the consultation is non-refundable
-
failure to attend / no-show – the consultation is non-refundable
Where we allow rescheduling, this will be at our discretion and subject to availability.
If we need to cancel or reschedule
If we need to cancel or rearrange a consultation, we will try to give you as much notice as possible and will offer either:
-
a rearranged appointment, or
-
a refund of any fee paid for that consultation
Our right not to proceed with a consultation
We reserve the right not to offer, continue with or proceed with a consultation where we reasonably believe:
-
the requested support falls outside the scope of the Service
-
there is a patient safety concern or safeguarding concern
-
the booking has been made using inaccurate or misleading information
-
the user’s needs would be better met by another healthcare professional or service
-
the appointment is otherwise inappropriate for delivery through the Service
If we decide not to proceed with a consultation before it takes place, we will normally offer a refund of the consultation fee already paid unless the cancellation is due to misuse of the Service, abusive behaviour, fraud, or another serious breach of these Terms.
Scope of consultations
Consultations booked through the Service are intended to provide support, education and guidance within the scope of the Service. Booking a consultation does not guarantee diagnosis, treatment or prescribing, and consultations do not constitute an emergency care service.
9. Intellectual property
All intellectual property rights in the Service and its content are owned by, licensed to, or controlled by Evolve GLP-1 unless otherwise stated.
This includes, without limitation:

text

graphics
-
logos
-
branding
-
app content
-
written materials
-
software elements
-
design, layout and visual content
You may use the Service and its content only for your own personal, non-commercial use in connection with the Service.
You must not, without our prior written permission:
-
copy, reproduce, republish, distribute or commercially exploit any content from the Service
-
adapt, modify, create derivative works from or otherwise use our content outside the permitted use of the Service
-
remove any copyright, trade mark or other proprietary notices
Nothing in these Terms transfers ownership of any intellectual property rights to you.
10. Data protection and privacy
We handle personal information in accordance with our Privacy Notice.
Our Privacy Notice explains how we collect, use, store and share your information, including health-related information and how long we keep records.
By using the Service, you acknowledge that we may process your personal information in accordance with our Privacy Notice and applicable data protection law.
11. Suspension, termination and account closure
We may suspend, restrict or terminate your access to the Service immediately or at any time if:

you breach these Terms
-
we reasonably believe there is a risk to patient safety, safeguarding, fraud, abuse, unlawful conduct or harm to our staff, users or systems
-
we believe the Service is being misused
-
you fail to make payment for a paid service
-
we are required to do so by law, regulation, court order, professional duty or safeguarding obligations
You may stop using the Service at any time and may close your account in accordance with the options made available to you.
Effect of account closure
If your account is closed or terminated:
-
your right to access the Service may end immediately or at the end of any current paid subscription period, depending on the circumstances
-
any outstanding amounts due to us will remain payable
-
booked consultations may be cancelled in accordance with these Terms
-
we may retain certain records, including healthcare-related, consultation, payment or account records, where required for legal, regulatory, safeguarding, insurance, security or medico-legal purposes

12. Limitation of liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
-
death or personal injury caused by negligence
-
fraud or fraudulent misrepresentation
-
any other liability that cannot lawfully be excluded or limited
Subject to the above, and to the fullest extent permitted by law:
-
the Service is provided on an “as available” basis
-
we do not guarantee that the Service will always be uninterrupted, error-free, secure, or available at any particular time
-
you remain responsible for seeking appropriate medical advice and for decisions about your treatment, medication and healthcare
-
we are not liable for losses that were not reasonably foreseeable
-
we are not liable for indirect or consequential loss, loss of profits, loss of business, loss of opportunity, or loss of goodwill arising out of or in connection with your use of the Service
-
we are not liable for losses caused by your failure to provide accurate information, your failure to seek appropriate medical advice, your misuse of the Service, or events outside our reasonable control

we are not responsible for the content, availability or policies of third-party platforms, app stores, payment processors or external websites, although this does not affect any rights you may have against those providers directly
Nothing in this section affects your statutory rights as a consumer.
13. Third-party services and platforms
The Service may rely on or integrate with third-party providers, including payment processors, booking platforms, hosting providers, analytics providers, app stores, communications tools and software services.
We are not responsible for:

the availability of third-party platforms
-
errors caused by third-party systems outside our reasonable control
-
separate terms, privacy policies or practices of third-party providers
If you use a third-party platform in connection with the Service, you may also be subject to that provider’s own terms and privacy policies.
14. Changes to these Terms
We may update these Terms from time to time to reflect:

changes to the Service
-
changes to pricing or subscription structures
-
legal, regulatory or professional requirements
-
operational or business changes
If we make material changes, we will take reasonable steps to notify users, for example through the app, website or by email where appropriate.
The updated Terms will take effect from the date stated at the top of the document. By continuing to use the Service after the updated Terms come into effect, you agree to the revised Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
Any dispute or claim arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer law allows otherwise.
